These Terms of Service (“Terms”) govern your access to and use of:

- partner or affiliate inquiry forms;
- customer support channels;

Together, these are referred to as the “Services.”

By accessing or using the Services, placing an order, submitting a form, requesting a demo, requesting a quote, purchasing a product, using a private checkout link, using our app, participating in a pilot program, applying to become a partner, joining an affiliate program, or otherwise engaging with CoolCovery, you agree to these Terms.
If you do not agree to these Terms, please do not use the Services.

If your purchase, partnership, pilot, distribution, resale, or commercial relationship is governed by a separate written agreement, quotation, invoice, purchase order, distributor agreement, partner agreement, affiliate agreement, or pilot agreement, that separate document may include additional or different terms.
If there is a conflict between these Terms and a separate written agreement that applies to your specific relationship with CoolCovery, the separate written agreement will control for that relationship, unless mandatory law provides otherwise.
- Our Products and Services
CoolCovery provides smart cold, heat, and compression recovery systems, accessories, app services, connected-device features, product education, customer support, demo programs, professional packages, partner programs, affiliate programs, and related services.
Our products and services may be offered through:
- public website pages;
- request-a-quote process;
- professional demo process;
- private checkout links;
- manual invoices;
- written quotations;
- B2B quotations;
- commercial agreements;
- distributor or reseller channels;
- pilot or trial programs;
- app services;
- approved partner or affiliate programs.
Not all products are available for open public checkout.
Certain products, professional systems, commercial packages, B2B packages, premium home recovery systems, trial units, demo units, or customized configurations may require consultation, qualification, safety confirmation, configuration review, shipping availability confirmation, or a written quotation before purchase.
- Important Health and Safety Notice
CoolCovery products and content are intended for recovery, wellness, performance, lifestyle, product education, and customer support purposes unless a specific product, claim, market, or use case has been separately cleared, approved, authorized, or otherwise permitted under applicable medical device or health product laws.
CoolCovery is not a healthcare provider. Our website, app, product information, marketing materials, demo materials, customer support communications, guided routines, and other content are not intended to provide medical advice, diagnosis, treatment, rehabilitation, emergency support, or clinical decision-making.
You should not use CoolCovery products or Services as a substitute for professional medical advice, diagnosis, treatment, rehabilitation, or emergency care.
Consult a qualified healthcare professional before using any cold, heat, compression, or recovery product if you:
- have a medical condition;
- recently had surgery;
- have circulation problems;
- have heart or vascular conditions;
- have blood clot risks;
- have impaired sensation;
- have diabetes-related nerve issues;
- are pregnant or may be pregnant;
- have implanted medical devices;
- have skin injury, infection, rash, or open wounds;
- are under medical care;
- are unsure whether cold, heat, or compression is appropriate for you.
Stop using the product immediately if you experience pain, numbness, dizziness, abnormal skin color, burning sensation, discomfort, shortness of breath, or any unusual reaction.
Always read and follow the user manual, safety instructions, warnings, contraindications, cleaning instructions, and operating guidelines provided with the product.
- Eligibility
You must be at least the age of majority in your place of residence to use the Services, place an order, request a quote, create an account, or enter into a binding agreement with CoolCovery.
If you use the Services on behalf of a business, clinic, gym, wellness center, hotel, sports organization, distributor, reseller, affiliate, partner, or other organization, you represent and warrant that you have authority to bind that organization to these Terms.
You may not use the Services if doing so would violate applicable law, sanctions, export control rules, import rules, or other legal restrictions.
- Accounts and Information You Provide
Some Services may require you to create an account or provide information.
You agree to provide accurate, complete, and current information when you:
- create an account;
- place an order;
- request a quote;
- book a demo;
- submit a form;
- apply to become a partner;
- join an affiliate program;
- contact support;
- use the App Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree not to impersonate another person, misrepresent your identity, provide false business information, submit misleading contact details, or use the Services for unauthorized purposes.
If you believe your account has been compromised, contact us promptly at support@coolcovery.com.
- App Services
CoolCovery may provide mobile applications, web applications, connected-device features, Bluetooth or wireless controls, guided recovery programs, account features, product settings, usage history, firmware updates, notifications, diagnostics, and other digital services (collectively, the “App Services”).
Your use of the App Services is subject to these Terms, our Privacy Policy, any in-app notices, any app store terms, and any additional terms provided within the app.
The App Services may allow you to:
- connect to compatible CoolCovery products;
- select guided recovery programs;
- adjust settings within permitted ranges;
- view product or session information;
- receive product updates, reminders, or notifications;
- access customer support;
- manage account information;
- receive firmware, software, or feature updates.
The App Services are provided for product operation, recovery routine support, wellness, customer support, and user convenience. They are not intended to provide medical advice, diagnosis, treatment, rehabilitation, emergency support, or clinical decision-making.
You are responsible for using the App Services in accordance with the product manual, safety instructions, contraindications, and applicable laws.
We may update, modify, suspend, or discontinue parts of the App Services from time to time.
Certain App Services may require:
- internet access;
- Bluetooth or wireless connectivity;
- compatible products;
- compatible mobile devices;
- operating system updates;
- app store access;
- account registration;
- permissions such as notifications, Bluetooth, device connectivity, or diagnostics.
We do not guarantee that the App Services will always be uninterrupted, error-free, available in every country, compatible with every device, or available for every product model.
Apple requires developers to disclose app data use and to request permission through App Tracking Transparency before tracking users across apps and websites where applicable; Google Play requires account deletion disclosures and processes where apps allow account creation.
- App Accounts and Account Deletion
Some App Services may require you to create an account.
You agree to provide accurate, complete, and current account information and to keep your login credentials secure.
If the App Services allow account creation, we will provide a way for you to request account deletion through the app or through a web-based method, email, or request form where required by applicable platform rules or privacy laws.
Account deletion may not immediately delete information that we are required or permitted to retain, such as:
- transaction records;
- warranty records;
- safety records;
- product support records;
- security records;
- fraud prevention records;
- legal compliance records;
- dispute records;
- information necessary to complete pending support, return, repair, or warranty requests.

- Orders, Quotes, and Acceptance
Submitting an order, request, quote request, form, purchase order, payment, or checkout request does not necessarily mean that CoolCovery has accepted your order.
We may accept, reject, cancel, or place an order on hold where reasonably necessary, including if:
- product availability changes;
- pricing or product information contains an error;
- payment cannot be verified;
- fraud risk is detected;
- shipping to your location is unavailable;
- the order appears intended for unauthorized resale;
- the product use appears unsafe or inappropriate;
- required consultation or safety confirmation has not been completed;
- legal, regulatory, sanctions, export, or import restrictions apply;
- the product is not supported in your country or region.
For B2B, commercial, distributor, reseller, pilot, professional, or custom orders, your order may be subject to a separate quotation, invoice, purchase order, pilot agreement, distributor agreement, partner agreement, or commercial contract.
- Pricing and Payment
Prices are shown in [CURRENCY] unless stated otherwise.
Prices may exclude:
- shipping fees;
- taxes;
- VAT;
- GST;
- customs duties;
- import charges;
- brokerage fees;
- installation fees;
- training fees;
- service fees;
- local compliance costs;
- other charges unless expressly stated.
We reserve the right to change prices at any time. Price changes will not affect orders already accepted by CoolCovery, unless there was an obvious pricing error or the applicable law allows correction.
Payment may be processed through:
- Shopify;
- Shop Pay;
- credit card processors;
- PayPal;
- bank transfer;
- invoice;
- wire transfer;
- other payment methods approved by CoolCovery.
You represent and warrant that you are authorized to use the payment method provided.
For B2B, commercial, distributor, reseller, or partner orders, payment terms may be stated in the relevant quotation, invoice, purchase order, or written agreement.
- Taxes, Duties, and Import Charges
Depending on your location and the shipping method, you may be responsible for:
- taxes;
- VAT;
- GST;
- customs duties;
- import fees;
- brokerage fees;
- customs clearance charges;
- government charges;
- other local charges.
Unless we clearly state that an order is shipped on a duties-paid basis, international customers may be responsible for import-related charges.
You are responsible for checking whether the product can be lawfully imported, purchased, possessed, and used in your country or region.
We are not responsible for delays, refusals, seizures, penalties, storage fees, or additional costs caused by customs requirements, import restrictions, incomplete documentation, unpaid duties, or your failure to provide required information.
- Shipping, Delivery, and Risk
Shipping and delivery are governed by our Shipping Policy and any applicable quotation, invoice, purchase order, or written agreement.
Delivery dates are estimates unless expressly stated as guaranteed in writing.
Shipping times may be affected by:
- customs;
- carrier delays;
- remote locations;
- holidays;
- weather;
- payment verification;
- supply chain issues;
- product availability;
- stock allocation;
- regulatory checks;
- force majeure events;
- incomplete shipping information.
For B2B, freight, distributor, reseller, or commercial orders, additional shipping terms may apply, including freight terms, delivery inspection obligations, signature requirements, insurance arrangements, or Incoterms if agreed in writing.
Risk of loss and title will pass according to the applicable law, shipping method, and any agreed commercial terms.
- Returns, Refunds, and Cancellations
Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy and any applicable quotation, invoice, purchase order, written agreement, or mandatory legal rights.
Some products may not be eligible for change-of-mind returns, including:
- opened hygiene-sensitive accessories;
- used body-contact items;
- customized products;
- commercial packages;
- B2B orders;
- pilot or demo units;
- distributor orders;
- reseller orders;
- digital content or App-related services where performance has begun and withdrawal is not available under applicable law.
Nothing in this section limits your mandatory legal rights.
- Warranty
Warranty coverage, warranty period, covered defects, exclusions, repair process, replacement process, and service limitations are described in our separate Warranty Policy or in the applicable quotation, invoice, agreement, or product documentation.
Warranty coverage may not apply to:
- misuse;
- improper installation;
- unauthorized repair;
- modification;
- failure to follow the manual;
- failure to follow cleaning instructions;
- normal wear and tear;
- commercial use where not covered;
- use with incompatible accessories;
- damage caused by improper storage;
- damage caused by improper transport;
- damage caused by unauthorized service;
- consumables or hygiene items unless defective;
- software or App issues caused by incompatible devices or unsupported operating systems.
Mandatory consumer rights are not limited by our warranty.
- Professional, Commercial, and B2B Use
If you use CoolCovery products in a professional, commercial, clinic, gym, wellness, hotel, sports, event, team, or multi-user environment, you are responsible for:
- training staff;
- following product manuals and safety instructions;
- screening users before use;
- displaying contraindications and safety warnings;
- using approved recovery routines only;
- cleaning and disinfecting products between users;
- maintaining equipment;
- keeping service records where appropriate;
- ensuring safe storage;
- using compatible accessories only;
- complying with applicable health, safety, consumer protection, privacy, employment, infection control, advertising, and electronic marketing laws;
- not making unauthorized medical, therapeutic, clinical, regulatory, or performance claims.
You may not represent that CoolCovery products treat, cure, diagnose, prevent, or mitigate any disease, injury, pain, inflammation, post-surgical condition, or medical condition unless expressly authorized by CoolCovery in writing and supported by applicable regulatory clearance and evidence.
- Product Use Restrictions
You agree not to:
- use the product contrary to the user manual;
- use the product on individuals with contraindications without appropriate professional guidance;
- modify or tamper with the product;
- repair the product through unauthorized providers;
- bypass safety features;
- use incompatible accessories;
- use damaged components;
- use the product for unauthorized medical treatment claims;
- resell products without authorization;
- use the product in countries or settings where it is not legally allowed or supported;
- remove labels, warnings, serial numbers, or safety markings;
- use the product in an unsafe, abusive, negligent, or unlawful manner;
- use the product in a way that may cause harm to users, property, or CoolCovery’s reputation.
- Affiliate, Partner, Influencer, and Referral Promotions
CoolCovery may work with affiliates, partners, influencers, creators, distributors, resellers, clinics, gyms, wellness operators, referral partners, or other collaborators.
Unless separately authorized in writing, affiliates and partners are independent parties and are not employees, agents, legal representatives, medical representatives, or authorized spokespersons of CoolCovery.
Affiliates, partners, influencers, and referral partners must:
- use only approved brand materials, product descriptions, claims, images, videos, and pricing information;
- clearly disclose any material connection with CoolCovery, including commissions, referral fees, free products, discounts, sponsorships, affiliate links, or other benefits;
- comply with all applicable advertising, privacy, consumer protection, electronic marketing, platform, and affiliate laws;
- avoid false, misleading, exaggerated, or unsupported claims;
- avoid unauthorized medical, therapeutic, clinical, regulatory, or performance claims;
- avoid claiming that CoolCovery products treat, cure, diagnose, prevent, or mitigate any disease, injury, pain, inflammation, surgical condition, or medical condition;
- avoid using “FDA approved,” “clinically proven,” “guaranteed faster recovery,” “reduces inflammation,” “treats pain,” or similar claims unless expressly approved by CoolCovery in writing and supported by applicable evidence and regulatory status;
- not misrepresent pricing, availability, warranty, shipping, returns, product capabilities, or commercial terms;
- not send spam, misleading emails, or unauthorized commercial electronic messages;
- not bid on restricted brand keywords, domain names, or confusingly similar names unless authorized;
- not use fake reviews, misleading testimonials, bots, fake traffic, cookie stuffing, deceptive attribution methods, or unauthorized tracking.
CoolCovery may suspend, withhold commissions, terminate participation, require content removal, or take other appropriate action if an affiliate or partner violates these Terms, applicable law, platform rules, or CoolCovery’s brand and claim guidelines.
FTC guidance emphasizes that endorsements and influencer promotions should disclose material connections such as commissions, free products, sponsorships, or other benefits.
- Reviews, Testimonials, and User Content
If you submit reviews, ratings, comments, photos, videos, feedback, testimonials, survey responses, or other content (“User Content”), you grant CoolCovery a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, translate, distribute, and otherwise use that User Content for product, service, marketing, research, support, and business purposes, subject to applicable law.
You represent and warrant that:
- your User Content is truthful;
- you have the right to submit it;
- it does not violate another person’s rights;
- it does not contain confidential, medical, or sensitive information about yourself or others;
- it does not contain false, misleading, or unsupported health claims;
- it does not mislead consumers;
- it does not violate applicable law or platform rules.
We may remove, refuse, moderate, or edit User Content at our discretion where permitted by law.
If you received compensation, a free product, discount, affiliate commission, referral benefit, sponsorship, or other benefit in exchange for a review, endorsement, testimonial, or post, you must clearly disclose that relationship.
- Electronic Marketing and Direct Marketing
If you subscribe to marketing communications, request information, participate in a referral program, interact with an affiliate or partner campaign, or otherwise provide consent where required, we may send you marketing communications in accordance with your choices and applicable law.
Where required, we will provide appropriate notices, obtain consent, identify the sender, include an unsubscribe method, and honor opt-out requests.
Affiliates, partners, distributors, resellers, and other collaborators must not use personal data for direct marketing, send commercial electronic messages, or contact prospects on behalf of CoolCovery unless they have the legal right to do so and comply with applicable direct marketing, privacy, anti-spam, and platform rules.
- Intellectual Property
All content on the Services, including text, graphics, images, videos, product names, logos, icons, page layouts, product descriptions, downloads, app interfaces, software, recovery program names, designs, and other materials, is owned by CoolCovery or its licensors and is protected by copyright, trademark, design, trade secret, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, sell, license, publicly display, publish, scrape, mirror, create derivative works from, reverse engineer, decompile, disassemble, or commercially exploit any part of the Services without our prior written permission, except where permitted by applicable law.
Authorized partners, affiliates, resellers, distributors, or collaborators may use approved brand assets only in accordance with CoolCovery’s brand guidelines and written authorization.
- Software, App Updates, and Firmware
The App Services, connected-device software, firmware, and related digital features may be updated from time to time.
Updates may include:
- bug fixes;
- security updates;
- feature improvements;
- product compatibility changes;
- firmware updates;
- safety updates;
- performance improvements;
- removal or modification of features.
You agree not to:
- reverse engineer software or firmware;
- bypass technical restrictions;
- use unauthorized firmware;
- interfere with update mechanisms;
- use modified apps;
- access restricted functions;
- attempt to gain unauthorized access to connected devices or systems.
Some features may require updated software, firmware, operating systems, or compatible devices.
- Third-Party Services and Links
Our Services may include or integrate with third-party services such as:
- Shopify;
- payment processors;
- shipping providers;
- app stores;
- chat tools;
- review tools;
- affiliate tools;
- analytics providers;
- advertising platforms;
- social media platforms;
- external websites.
We are not responsible for third-party services that we do not control.
Your use of third-party services may be subject to their own terms, privacy policies, rules, and fees.
The inclusion of a third-party link or integration does not imply endorsement unless we expressly state otherwise.
- Privacy
Our collection, use, disclosure, storage, transfer, and protection of personal information is described in our Privacy Policy and Cookie Policy.
By using the Services, you acknowledge that we may process personal information as described in those policies.
Where required by applicable law, we will request consent for certain uses of personal information, cookies, tracking technologies, direct marketing, or app permissions.
Hong Kong’s Personal Data (Privacy) Ordinance governs personal data protection in Hong Kong, and the EU/EEA, UK, U.S. state privacy laws, and other laws may apply depending on user location and processing activities.
- Prohibited Uses
You may not use the Services:
- for unlawful, fraudulent, deceptive, harmful, or abusive purposes;
- to violate laws, regulations, sanctions, export control rules, or third-party rights;
- to submit false, incomplete, or misleading information;
- to interfere with website, app, product, or system security;
- to scrape, crawl, harvest, or copy the Services without authorization;
- to transmit malware, harmful code, or unauthorized tracking tools;
- to make unauthorized medical, therapeutic, regulatory, or performance claims;
- to resell products without authorization;
- to impersonate another person or business;
- to abuse returns, refunds, promotions, warranty, affiliate, or referral programs;
- to manipulate reviews, testimonials, traffic, affiliate attribution, or campaign measurement;
- to use the Services in a way that may harm CoolCovery, users, partners, or third parties.
- Disclaimers
To the maximum extent permitted by law, the Services and website content are provided “as is” and “as available.”
We do not guarantee that:
- the Services will be uninterrupted or error-free;
- the app will be compatible with every device or operating system;
- product information will always be free from typographical errors;
- product availability will remain unchanged;
- website or app content will meet every user’s needs;
- results from using the product will be identical for all users;
- recovery outcomes, wellness outcomes, performance outcomes, or commercial outcomes are guaranteed;
- affiliate links, promotional offers, or third-party integrations will always function without interruption.
Nothing in these Terms excludes or limits rights, warranties, guarantees, or remedies that cannot be excluded or limited under applicable law.
- Limitation of Liability
To the maximum extent permitted by law, CoolCovery and its officers, directors, employees, contractors, agents, suppliers, licensors, distributors, affiliates, partners, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business, loss of data, loss of goodwill, business interruption, or loss of commercial opportunity.
To the maximum extent permitted by law, our total liability for any claim relating to the Services or products will not exceed the amount you paid directly to CoolCovery for the product or service giving rise to the claim.
These limitations do not apply where prohibited by law, including liability that cannot be excluded or limited for fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence, or mandatory consumer rights where applicable.
Some jurisdictions do not allow certain liability exclusions or limitations, so some of the above limitations may not apply to you.
- Indemnification
If you are a business, commercial user, professional service provider, distributor, reseller, partner, affiliate, influencer, clinic, gym, wellness operator, sports organization, or other non-consumer user, you agree to indemnify and hold harmless CoolCovery and its officers, directors, employees, contractors, agents, suppliers, licensors, distributors, affiliates, partners, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:
- your misuse of the products;
- unauthorized medical, therapeutic, performance, or regulatory claims;
- failure to train staff;
- failure to screen users;
- failure to follow safety instructions;
- failure to clean or maintain products;
- unauthorized resale;
- misleading advertising;
- fake reviews or undisclosed endorsements;
- violation of these Terms;
- violation of applicable law;
- infringement of third-party rights;
- breach of a partner, affiliate, distributor, or commercial agreement;
- unsafe or unlawful use of CoolCovery products or Services.
This section applies only to the extent permitted by law.
- Changes to the Services and Terms
We may update the Services, product information, pricing, features, policies, App Services, and these Terms from time to time.
If we make material changes, we may provide notice where required by law.
The updated Terms will apply from the “Last Updated” date unless otherwise stated.
Your continued use of the Services after the updated Terms become effective means you accept the updated Terms, where permitted by law.
- Suspension and Termination
We may suspend or terminate your access to the Services, app account, partner account, affiliate participation, or other features if you:
- violate these Terms;
- misuse the Services;
- submit false information;
- engage in fraud;
- make unauthorized claims;
- abuse returns, refunds, warranty, affiliate, or referral programs;
- violate applicable law;
- create safety risks;
- use the Services in a way that may harm CoolCovery, users, partners, or third parties.
Termination does not affect rights or obligations that arose before termination.
- Force Majeure
We are not responsible for delay or failure to perform due to events beyond our reasonable control, including:
- natural disasters;
- extreme weather;
- pandemics;
- war;
- terrorism;
- civil unrest;
- labor disputes;
- transport disruptions;
- customs delays;
- supply chain interruptions;
- power outages;
- cyberattacks;
- government actions;
- regulatory changes;
- platform outages;
- carrier failures;
- other events beyond our reasonable control.
- Governing Law and Dispute Resolution
These Terms are governed by the laws of Hong Kong.
Subject to any mandatory consumer protection laws that may apply in your place of residence, you and CoolCovery agree that the courts of Hong Kong will have exclusive jurisdiction over any dispute, claim, or proceeding arising out of or relating to:
- these Terms;
- the Services;
- your use of our website or app;
- any direct purchase from CoolCovery;
- any private checkout transaction;
- any product or service provided directly by CoolCovery.
For B2B, distributor, reseller, affiliate, partner, pilot, commercial, or professional arrangements, a separate written agreement may apply. If a separate written agreement contains a different dispute resolution clause, that separate agreement will control for that specific relationship.
Nothing in this section limits any mandatory rights that cannot be excluded under applicable law.
- EU/EEA and Other Mandatory Consumer Rights
If you are a consumer located in the EU/EEA, UK, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits any rights you may have under those mandatory laws.
The EU Consumer Rights Directive regulates consumer distance contracts, including withdrawal rights, trader information duties, delivery, and passing of risk for consumer sales of goods.
Where mandatory law gives you rights that cannot be waived, those rights apply despite anything in these Terms.
- Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
- No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
- Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights or obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, or other business transaction, subject to applicable law.
- Entire Agreement
These Terms, together with any policies, notices, quotations, invoices, written agreements, or additional terms that apply to your use of the Services or purchase, form the agreement between you and CoolCovery regarding the Services.
